Revenge is a Dish Best Served Up Naked, and in Court!

So apparently they have these web sites you can visit where guys post pictures of naked girls. On some of these sites, the guys are just regular Joes who happen to have nekkid pictures of their girlfriends, their former girlfriends.

Call them XXX Girlfriends.

First off, you’ve got to be an idiot to take a digital picture of anyone doing something you wouldn’t want your pastor to see. I’ve nothing against intimacy and, well, ever since the Polaroid (or home darkrooms) people have snapped nekkid pictures. But in the digital age? With the Internet looming everywhere. That just has stupid written all over it.

Before computers I was into photography. I was friendly with the folks at the place I went to to develop pictures (when I was in a rush and didn’t want to use my own darkroom). One day I asked the employees how often they see nekkid pictures.

All. The. Time.

Some they would refuse to develop. Well! What was the point of that? They’d already seen them. But, no, they could “get in trouble.” I never pursued the issue further.

So nekkid bedroom photography has been around a while. The ability to mass produce the images on the Internet? That’s new.

Second, do you really own the rights to your former paramour’s visage, well enough and with consent to publish those images on a lurid web site?

According to a lawsuit filed recently, that question is in doubt. You can read the details on this web site.

Some gal was apparently informed that she was “the girl from that web site.”

Oh, joy.

Honey, I bet it sure seemed like a great idea at the time! Probably like all those bozos on Facebook who post pictures of themselves underage drinking, doing illegal drugs, or posing in a house they just burgled. Humanity’s stupidity resource isn’t running dry in the information age.

Third, there’s the scandalous element of revenge involved here. Apparently the issue isn’t just “Share Your Honey” on the Internet, but rather, some guy got dumped or otherwise ended the relationship and then — Whoa, Nellie! — he remembers that cache of compromising photos in the Droid X or wherever. “Bwaa-ha!” he mutters as he clicks the Upload button.

It’s not really a clear-cut legal case. To be honest, and Hollywood fiction aside, very few things in court are.

Obviously the gals gave permission to the guys when the picture was snapped. No need to sign a release form! Damn! She looks like a willing participant there, especially after image 35. Oh! And there’s a second set?

But on the other side, was there an agreement to distribute the images? Was that the intent? Could the judge’s decision determine that images taken with a private intent must remain private? Other issues doubtless will arise.

Finally, I’m happy the woman is willing to take her former scumbag boyfriend to court. What he did, regardless of whether it was legal or not, was a despicable thing. The guy needs to have a warning affixed to his body to ward off future victims. That’s just my opinion.
